H-1B Lottery & Registration Stage
  • Cap-subject H-1B visas (new applicants subject to the annual quota) begin with an online registration in March each year.
  • The lottery results are usually announced within 2–3 weeks (by the end of March/early April).
SCIS Petition Processing (Form I-129)
  • Regular Processing:
    Typically 3 to 6 months, depending on workload at the USCIS Service Center (California, Vermont, Texas, Nebraska, or Potomac).
  • Premium Processing:
    If the employer pays the USD 2,805 premium fee, USCIS guarantees a decision (approval, denial, or RFE – Request for Evidence) within 15 calendar days.
Visa Stamping at U.S. Consulate (Outside the U.S.)
  • After USCIS approval (Form I-797 Notice of Action), the applicant must apply for a visa stamp.
  • DS-160 completion, fee payment, and interview scheduling: Timeline varies by country and consulate.
  • Consular processing time: Usually 1–4 weeks after the interview, if no administrative processing is required.
